“N.W.T. SPCA Calls for Recognition of Animals as Sentient Beings”

The N.W.T. SPCA is urging the territorial government to acknowledge domestic animals as sentient beings rather than mere property under the law. The current legislation, as outlined in the Dog Act, categorizes dogs as possessions of their owners. The SPCA has received ongoing feedback from visitors and residents expressing concerns about animal welfare in the Northwest Territories, emphasizing that existing laws restrict the ability of authorities to intervene effectively.

Nicole Spencer, the executive director of the N.W.T. SPCA, highlighted that the current regulations, while setting basic standards like food, water, and shelter, may not adequately address more intricate animal welfare issues. Lawyer Jennifer Friedman noted that pets being viewed as property is a common practice, not only in Ontario but also in various Canadian jurisdictions. However, some provinces, like British Columbia in 2024, are moving towards expanding legal considerations in family disputes involving pets.

Friedman emphasized the importance of enforcing animal protection laws, stating that the lack of enforcement is a common complaint among the public. The Department of Municipal and Community Affairs, responsible for administering the Dog Act, stated that there are no immediate plans to revise the legislation, citing broader legislative priorities. Minister Vince McKay reiterated that the act serves as a foundational document for municipalities, indicating that any amendments would need to align with broader legislative objectives.

McKay acknowledged the longstanding period since the last update to the Dog Act and mentioned the potential for future review, emphasizing the need for a balance between establishing baseline protections and allowing communities to create additional regulations through bylaws. The minister stressed the importance of safeguarding communities where capacity for creating bylaws is limited, while also encouraging municipalities to enhance animal welfare provisions based on their specific needs.
