Former South Korean president Yoon Suk Yeol has been sentenced to a five-year prison term by a South Korean court. The charges against him include impeding authorities from arresting him after his unsuccessful attempt to enforce martial law in December 2024.
Yoon was found guilty by the Seoul Central District Court for deploying the presidential security service to obstruct the execution of a legally issued arrest warrant meant to investigate his martial law declaration. The court also convicted him of creating false official documents and failing to adhere to the legal processes associated with martial law.
This ruling marks the initial outcome of the criminal accusations against Yoon regarding his failed martial law declaration. The lead judge emphasized that Yoon misused his presidential authority to hinder the execution of lawful warrants through Security Service officials loyal to him, emphasizing personal safety and gain.
Following the court’s decision, one of Yoon’s legal representatives, Yoo Jung-hwa, announced that the former president intends to appeal the verdict, expressing disappointment over what they described as a politicized judgment. Yoon is facing a potential death sentence in a separate trial for allegedly orchestrating an insurrection by declaring martial law without justification.
Yoon has maintained that his declaration of martial law was within his presidential powers and aimed at raising awareness about government obstruction by opposition parties. In a separate incident, Yoon barricaded himself in his residence last year, prompting obstruction charges for which he could have faced a decade in prison. He was eventually apprehended during a subsequent attempt involving a significant police presence, becoming the first sitting South Korean president to be arrested.
Yoon’s martial law decree was swiftly overturned by Parliament, leading to his impeachment and suspension of powers. The Constitutional Court later removed him from office in April of the following year, ruling that he had breached the responsibilities of his position.
Despite lasting only a few hours, Yoon’s attempt to enforce martial law had significant repercussions in South Korea, a prominent Asian economy and a crucial U.S. ally known for its robust democratic traditions.
