The Alberta Energy Regulator (AER) has instructed MAGA Energy Ltd., an oil and gas company, to cease its operations due to unresolved environmental issues and non-compliance matters, such as outstanding taxes and orphan well cleanup fees. The AER’s directive, issued a day before the announcement on Thursday, mandates that the Calgary-based company halt its well operations, shut down equipment at its facilities, and cease using active pipelines, as per the agency’s order.

MAGA Energy currently manages 581 wells, 108 facilities, and 801 pipeline segments, as disclosed by the AER. The regulatory body stated in a press release that it took this action to safeguard the public and the environment. Citing MAGA’s overdue municipal taxes, debts to AER and the Orphan Well Association, and failure to meet obligations, the AER concluded that the company lacks the capacity to fulfill its regulatory and liability duties.

The order specifies various conditions that MAGA must rectify before resuming operations, including addressing remediation concerns at multiple sites, resolving pending field inspections, and allocating the minimum mandated funds for inactive site cleanup. Sturgeon County highlighted that MAGA Energy owes over $356,000 in property taxes and penalties, emphasizing the importance of companies meeting tax obligations to support municipalities.

The AER had previously approved the transfer of wells, facilities, and pipeline licenses to MAGA Energy. However, concerns regarding tax arrears and operational responsibilities have led to the recent suspension order. Sturgeon County’s previous documentation revealed MAGA Energy’s tax arrears dating back to 2021, prompting calls for stronger enforcement mechanisms to ensure timely tax payments.

Energy Minister Brian Jean’s office commented on the suspension of MAGA Energy operations, stating that Alberta’s policies and regulations are effective in holding companies accountable for environmental and taxpayer responsibilities. Meanwhile, industry experts have raised concerns about regulatory leniency towards oil and gas firms and the potential challenges in recovering unpaid taxes from the sector.

The Pembina Institute highlighted the need for stricter enforcement of regulations and levies to prevent financial burdens and environmental risks from falling on Albertans. As the industry faces challenges with orphan well management and inadequate levy amounts, stakeholders urge policy changes to ensure industry accountability and environmental protection.
