“AI Dealer Drama: BMW Toronto Bot’s Buy-Back Blunder”

Zack Giacomelli, a 31-year-old funeral director, recently experienced a rollercoaster of emotions during a buy-back deal gone wrong with BMW Toronto. After his 2021 BMW required extensive repairs, Giacomelli sought to sell it back to the dealership where he had initially purchased the used car in 2023.

Initially, the process seemed straightforward as Quinn from BMW Toronto, who turned out to be an artificial intelligence chatbot rather than a real person, made a buy-back offer of $27,162.79 via text message. This offer was just enough to cover the remaining amount Giacomelli owed on the car, leaving him feeling content.

However, the situation took a sharp turn when the dealership retracted the offer, stating that Quinn had made an error in the offer. The actual revised buy-back offer was significantly lower at $20,000, leaving Giacomelli shocked and disappointed.

This incident raises the question of whether AI can enter into contracts on behalf of companies, highlighting the potential risks and legal implications of using artificial intelligence tools in customer interactions. In a similar case involving Air Canada, the company was held accountable for incorrect information provided by its chatbot, emphasizing the responsibility that companies bear for the actions of their AI systems.

Despite the confusion and frustration, the dealership eventually reinstated Quinn’s original offer of $27,162.79 after CBC News intervened. Moving forward, BMW Toronto has decided that only human employees will handle presenting buy-back offers to customers to avoid similar misunderstandings.

As Canadian businesses increasingly adopt AI tools to improve customer service, the potential for disputes and customer dissatisfaction may rise. Companies must ensure transparency in their use of AI and be prepared to rectify any errors made by their automated systems to maintain trust and uphold their corporate responsibility to customers.
