“Anglican Bishop Criticizes Alberta’s Use of Notwithstanding Clause”

The Anglican Diocese of Edmonton has raised issues regarding the Alberta government’s utilization of the notwithstanding clause to compel striking teachers to return to work. Bishop Stephen London penned an open letter that was published online this week, expressing his concerns. While stating that he does not aim to engage in partisan politics, London believes that the legislation could potentially jeopardize the religious freedoms of Canadians.

London highlighted that invoking the clause to end the teachers’ strike contradicts the Charter’s right to freedom of association. He emphasized that infringing on one group’s fundamental rights could have broader implications that might impede individuals’ freedom of conscience and religion.

Last week, the United Conservative Party government invoked the notwithstanding clause to expedite back-to-work legislation and resolve a provincewide teachers strike that commenced on October 6. London urged Premier Danielle Smith to retract the legislation and enable teachers to continue their collective bargaining efforts.

In his open letter, London described the decision as significant beyond regular politics, emphasizing the moral and spiritual aspects of the issue. He underscored the centrality of democratic rights and freedoms in Canadians’ lives, asserting that they are indispensable for a free society, especially in light of the global fragility of democratic institutions.

Heather Jenkins, Justice Minister Mickey Amery’s press secretary, defended the government’s use of the notwithstanding clause, stating that it is a crucial tool to maintain a balance of power between courts and democratically elected governments. Jenkins emphasized that the decision was made in the public interest to ensure students’ return to classrooms.

The Catholic Archdiocese of Edmonton did not immediately respond to inquiries regarding whether it shares London’s apprehensions about the situation.
