Manitoba Premier Wab Kinew sparked controversy on Monday by criticizing a recent Supreme Court of Canada decision regarding child pornography and advocating for harsher punishments for offenders. Kinew expressed strong disapproval, stating that individuals involved in child sexual abuse images and videos deserve severe consequences, including being placed in general prison population without protective custody.
The Supreme Court’s ruling deemed the one-year mandatory minimum jail sentences for child pornography unconstitutional, as it limited judges’ discretion in sentencing. Various Conservative figures, including Opposition Leader Pierre Poilievre, Alberta Premier Danielle Smith, and Ontario Premier Doug Ford, have urged the federal government to override the decision using the notwithstanding clause, allowing governments to bypass certain sections of the Charter of Rights and Freedoms.
Kinew, a member of the New Democratic Party, aligned himself with Smith, Ford, and others, criticizing the court ruling as illogical and labeling it “disgusting.” He also used derogatory language, referring to sex offenders as “skinners.” In response, the Criminal Defence Lawyers Association of Manitoba condemned Kinew’s comments, emphasizing the importance of maintaining a fair and just legal system.
The association rebuked Kinew for suggesting vigilante justice and highlighted his previous controversial remarks about the justice system. Kinew had previously apologized for comments made when his party expelled a member associated with a high-profile criminal case. The association underscored the necessity of upholding the rule of law and fair sentencing practices.
Kinew recently introduced a bill that mandates judicial review whenever the notwithstanding clause is invoked in Manitoba to override Charter rights. This bill aims to ensure transparency and accountability in the government’s use of the notwithstanding clause. Kinew has also criticized other provinces, such as Quebec, Alberta, and Saskatchewan, for using the clause in ways that he believes infringe upon the rights of vulnerable populations.
